Urgent Upcoming VOTE to protect Sunset Mesa - Update CC&Rs
In the coming weeks, SMPOA members will be sent information and ballots and asked to vote on three proposed amendments to our CC&Rs—rules that help protect our ocean views, neighborhood character, and property values.
Our governing documents have not been effectively updated since 2005. The recent tragic fire has highlighted the need to modernize our CCR’s to protect the character of Sunset Mesa. The changes will address gaps and ensure our rules remain clear, enforceable, and aligned with the values of our neighborhood. If ratified, the proposed amendments will achieve the following:
Protect Your Rights & Wallet – Legal Fee Recovery: Allow the prevailing party in CC&R enforcement cases to recover attorneys’ fees, so members can defend their property rights without bearing unreimbursed legal costs when they prevail.
Protect Your Views & Privacy – Roof Deck Prohibition: Add explicit CC&R language clarifying that roof decks are not permitted, preserving ocean views, privacy, tranquility and lasting precedent.
Protect Our Residential Character – 30 Day+ for Rentals: Require a minimum 30-day lease term for rentals, to prevent a swell in short-term vacation rentals while still allowing longer-term rentals.
We are advocating for a YES Vote on all three measures.
Without these clarifications, enforcement of view protections can remain costly to owners in the right, unauthorized roof decks could disrupt neighborhood harmony, and short-term vacation rentals could expand in ways that change the character of the neighborhood.
Each amendment can be voted on by you separately, and you do not need to agree to all three. You will be able to vote via a paper ballot or a website. An independent 3rd party company will supervise the voting and the vote counting.
Each amendment requires a majority of homeowner to approve in order to pass. If ballots are not returned, the amendments cannot be adopted—even if most voters support them. For that reason, every homeowner’s participation is important.
